The details above satisfy the identification duty imposed on electronic commerce by Art. 3(1)(s) of the Swiss Federal Act against Unfair Competition (UCA).

2. General Terms of Contract

2.1 The Owner's role: intermediation

BBCalaGonone acts as an intermediary: it collects the booking request, confirms it and receives the confirmatory deposit. The service at sea — rental, skippered excursion or mini cruise — is actually provided by the partner boat operator, who owns the vessels and holds the relevant authorisations and who is the supplier of the service towards the customer.

A booking therefore creates two separate relationships: the booking service with the Owner, and the rental or carriage contract with the operator, concluded when the boat is collected or at departure. The remaining balance is paid directly to the operator.

The identity and contact details of the operator are provided to the customer on request and, in any event, when the boat is collected or at departure.

2.2 Bookings and Rental

The specific rental terms (duration, costs, deposit, cancellation policy) are set out on the booking page, in the summary shown before payment and in the rental contract to be signed at the time the boat is collected.

2.3 Deposit and Payments

To confirm a booking, payment of a confirmatory deposit is required. Its amount varies according to the service and the boat selected and is always shown on the booking page and in the summary displayed before payment. The deposit is paid through the integrated PayPal system; the remaining balance is paid when the boat is collected or at departure, at the Cala Gonone harbour.

2.4 Cancellation Policy

• Up to 72 hours before: if you cancel at least 72 hours before the scheduled departure time, the deposit is refunded in full, whatever the reason.
• Within 72 hours: the deposit is non-refundable, with one exception: if the Harbour Master's Office suspends departures. In that case the customer chooses between a full refund of the deposit and moving the booking to another date.
• Less than perfect weather: rain, light wind or a slight swell that still allow the trip to go ahead do not give a right to a refund within 72 hours.

Where the service provides for the balance to be paid directly to the boat operator, this policy applies only to the deposit received by the Owner. The refund of any amount paid to the operator is governed by the operator’s own terms, for which the operator answers directly to the customer: the Owner neither guarantees nor advances it. The operator’s terms are shown to the customer before payment and provided on request.

2.5 Right of withdrawal

Distance contracts for leisure services to be performed on a specific date — including boat rental, sea excursions and mini cruises — are excluded from the fourteen-day right of withdrawal that applies to distance selling (Art. 16(l) of Directive 2011/83/EU, implemented in Italy by Art. 59(n) of the Consumer Code). Swiss law, for its part, provides no general right of revocation for contracts concluded online.

Only the cancellation policy set out under point 2.4 therefore applies to your booking, and the Owner applies it uniformly to every customer.

2.6 Customer Responsibility

The customer is responsible for complying with the Italian Recreational Boating Code ("Codice della Nautica da Diporto") and maritime safety regulations. In particular:

• Boats up to 40 HP may be operated without a boating licence;
• The customer must respect speed limits in protected areas and near the coast;
• Life jackets must be worn by all crew members;
• The customer is liable for any damage to the boat caused by negligence or violation of the rules.

3. Owner's Liability

BBCalaGonone is not liable for:

• Any damage resulting from adverse weather conditions or force majeure;
• Failure by the customer to comply with safety regulations;
• Content of external sites linked from the Site (sole responsibility of their respective owners);
• Any temporary service interruptions due to technical maintenance or technical issues.

As this is an intermediation service, the Owner is answerable for the correct handling of the booking and of the deposit received. Performance of the service at sea, the condition and maintenance of the vessels, the conduct of the skipper and compliance with safety requirements are the responsibility of the boat operator providing the service, who answers for them directly towards the customer. Mandatory consumer-protection rules remain unaffected.

4. Intellectual Property

All content on the website https://www.bbcalagonone.com — including text, images, logos, trademarks, graphics, video and code — is the exclusive property of BBCalaGonone or its respective rights holders and is protected by copyright and intellectual property law.

Reproduction, distribution, modification or unauthorised use of the content without the Owner's explicit written consent is prohibited. Images of the boats and destinations are used under licence or with the authorisation of their respective owners.

The management software is a separate and autonomous work. The booking and management system used on this Site — public interface, booking register, quotes and receipts, message templates, structure, operating logic and source code — constitutes an intellectual work distinct from the Site’s editorial content, and is the exclusive property of ZOSO TECH di Lucio Occhipinti, who develops it and licenses it separately to third parties.

Browsing the Site, purchasing a service or entering into any commercial relationship with the Owner transfers no right whatsoever over that software. Reproduction in whole or in part, resale, sub-licensing to third parties, the creation of derivative works, and any attempt at decompilation, disassembly or reconstruction of its internal logic are expressly prohibited, save within the mandatory limits of the law.

The photos on the Site come from:

• BBCalaGonone's own photo archive;
• Google Custom Search API (images under Creative Commons licence or otherwise reusable);
• Third-party service providers.

Photographer/source credits are indicated for each image, as required by law.

5. Limitation of Liability for External Content

The website https://www.bbcalagonone.com may contain links to third-party websites (e.g. YouTube for videos, Google Maps for maps, WhatsApp for contact). The Owner has no control over the content of such sites and disclaims any liability for damage arising from their use.

6. Applicable Law and Jurisdiction

The Owner of the Site is based in Switzerland; the services booked through the Site are performed in Italy, in the Gulf of Orosei.

Relations with the Owner are governed by Swiss law. This is without prejudice to the mandatory consumer-protection rules in force in the country of the customer's habitual residence: the choice of law cannot deprive the consumer of the protection those rules afford.

Jurisdiction is governed by the Lugano Convention of 30 October 2007, in force between Switzerland and the States of the European Union. Under it, a customer acting as a consumer may bring proceedings before the court of their own domicile or before that of the Owner's domicile, and may be sued only before the court of their own domicile.

Italian rules on navigation safety and the orders of the competent Harbour Master's Office remain applicable in any event to the performance of the service at sea.

7. Changes to this Legal Notice

The Owner reserves the right to modify this Legal Notice at any time. Changes take effect from the date of publication on the Site. We invite you to review this page periodically.
